  • purchases of products through our website;

  • products supplied by us;

  • our voluntary product warranty; and

  • your responsibilities when using our products.

Our Shipping Policy and Returns & Refunds Policy form part of the information governing your purchase and should be read alongside these Terms.

Where those policies contain specific information about shipping, returns, cancellations or refunds, the relevant policy will apply to that subject.

Nothing in our policies or these Terms affects statutory consumer rights that cannot legally be excluded or restricted.

You may use our website only for lawful purposes.

You must not:

  • use the website for fraudulent or unlawful purposes;

  • attempt to gain unauthorised access to our systems;

  • interfere with the operation or security of the website;

  • introduce malicious software, viruses or other harmful material;

We reserve the right to suspend or restrict access to the website where reasonably necessary to protect the website, our business, our customers or third parties.

PRODUCTS

We sell martial arts, fitness and training equipment and related products.

We make reasonable efforts to ensure that product descriptions, photographs, dimensions, colours and specifications displayed on our website are accurate.

However, minor variations may occur, including variations caused by:

  • manufacturing tolerances;

  • lighting or photography;

  • screen settings;

  • product batches; or

  • reasonable changes to product specifications.

Where a product has specific instructions, limitations, warnings or safety requirements, those requirements form part of the information provided with the product.

We reserve the right to modify product specifications where reasonably necessary, provided that any such modification does not adversely affect your statutory rights.

PRODUCT SAFETY

Your safety is extremely important to us.

Our products must be used only for their intended purpose and in accordance with the instructions, warnings and safety information supplied with the product.

Certain Ji products, including resistance-based training equipment, can involve inherent physical risks when used incorrectly.

You are responsible for:

  • reading and following all product instructions before use;

  • following all safety warnings;

  • inspecting products before each use;

  • ensuring attachments, anchors and connections are properly secured before use;

  • using products only for their intended purpose;

  • using products within any stated specifications or limitations;

  • stopping use immediately if a product appears damaged, defective or unsafe;

  • replacing products when they have reached the end of their safe usable condition; and

  • ensuring that children or other persons who should not use the product do not have access to it where the product is not intended for their use.

You must not modify, alter, repair or otherwise change a Ji product unless expressly authorised by Ji Martial Arts.

You must not use a product that is cracked, torn, excessively worn, damaged, deformed or otherwise appears unsafe.

RESISTANCE BAND SAFETY

Where you purchase or use a Ji Resistance Band or similar resistance product, you must carefully follow all product-specific safety instructions.

In particular, you must:

  • inspect the band and all associated components before every use;

  • check for cuts, tears, cracks, excessive wear, deformation or other damage;

  • ensure that all attachments and anchor points are correctly and securely installed;

  • avoid overstretching the product beyond its stated or recommended limits;

  • keep the product away from your face and neck;

  • maintain appropriate positioning during use;

  • stop using the product immediately if you observe damage or abnormal behaviour; and

  • replace the product when it shows signs that continued use may be unsafe.

The detailed safety instructions supplied with the product and made available through Ji Martial Arts may contain additional requirements.

Where a QR code or other digital safety guide is provided, you should review the relevant safety information before using the product.

INHERENT RISKS OF PHYSICAL TRAINING

Martial arts, fitness training, resistance training and physical exercise involve inherent risks, including the possibility of physical injury.

You are responsible for determining whether a particular activity or product is appropriate for you.

You should seek appropriate professional medical or fitness advice where you have concerns about whether physical exercise is suitable for you.

You should never use Ji products beyond their intended purpose or contrary to their safety instructions.

Nothing in this section is intended to exclude or restrict any liability or statutory right that cannot legally be excluded or restricted.

ORDERS

When you place an order through our website, you are making an offer to purchase the products selected by you.

After receiving your order, we may send an order confirmation acknowledging receipt of your order.

A confirmation of receipt does not necessarily mean that your order has been accepted.

We reserve the right to refuse or cancel an order where reasonably necessary, including where:

  • a product is unavailable;

  • there has been an obvious pricing or listing error;

  • we reasonably suspect fraudulent activity;

  • we are unable to fulfil the order;

  • a product has been identified as unsafe or potentially unsafe;

  • there is an error in the order; or

  • we are required to do so by law.

If we cancel an order after payment has been taken, we will provide an appropriate refund.

AVAILABILITY

We aim to maintain accurate information about product availability.

However, products may occasionally become unavailable due to:

  • stock discrepancies;

  • manufacturing issues;

  • supplier delays;

  • product safety concerns;

  • quality-control issues; or

  • circumstances outside our reasonable control.

If a product becomes unavailable after you place an order, we will contact you and provide an appropriate resolution in accordance with applicable law.

PRICES

All product prices are displayed on our website.

Prices may change from time to time. Any price change will not affect an order that we have already accepted, except where required or permitted by law.

We may make genuine errors in product pricing or descriptions. Where an obvious error occurs, we reserve the right to take appropriate corrective action, subject to your statutory rights.

Any applicable taxes, duties, customs charges or other import costs will depend on the destination and applicable laws.

Customers purchasing internationally are responsible for any applicable customs duties, taxes or import charges where these are legally payable by the customer.

PAYMENT

Payment must be successfully processed before an order can be fulfilled unless otherwise agreed by Ji Martial Arts.

Payments are processed through third-party payment providers.

We do not knowingly store complete payment card details on our own systems where payment processing is handled by a third-party payment provider.

By submitting payment information, you confirm that you are authorised to use the payment method provided.

SHIPPING AND DELIVERY

Shipping and delivery are governed by our separate Shipping Policy, which should be read alongside these Terms.

Delivery dates and estimates are provided in good faith and may be affected by circumstances outside our reasonable control, including carrier delays, customs processing and other logistical issues.

Nothing in our Shipping Policy or these Terms limits your statutory rights regarding delivery.

RETURNS, CANCELLATIONS AND REFUNDS

Returns, cancellations and refunds are governed by our separate Returns & Refunds Policy.

Where applicable, consumers purchasing online may have statutory cancellation rights in addition to rights relating to faulty or defective goods.

Nothing in our Returns & Refunds Policy or these Terms removes or restricts any statutory rights that cannot legally be excluded.

FAULTY, DAMAGED OR DEFECTIVE PRODUCTS

If you believe that a product is faulty, damaged or defective, please contact us as soon as reasonably possible and provide:

  • your order number;

  • the product concerned;

  • a description of the issue;

  • photographs or videos where appropriate; and

  • any other information reasonably required to assess the issue.

Where appropriate, we may request that the product be returned for inspection.

We may need to investigate whether the issue is consistent with:

  • a manufacturing defect;

  • damage occurring during delivery;

  • normal wear and tear;

  • accidental damage;

  • misuse;

  • improper installation or setup;

  • failure to follow product instructions; or

  • another cause.

Nothing in this section limits your statutory rights.

SIX-MONTH LIMITED PRODUCT WARRANTY

In addition to your statutory rights, Ji Martial Arts provides a six-month limited voluntary product warranty for eligible products.

Unless a product-specific warranty states otherwise, this voluntary warranty begins on the date the product is purchased.

The voluntary warranty covers defects in materials and workmanship that arise during the six-month warranty period, subject to the conditions below.

This warranty is provided in addition to, and does not replace, limit or exclude any statutory rights or remedies available to you.

WHAT THE VOLUNTARY WARRANTY COVERS

Where a product is determined to have a qualifying manufacturing defect during the voluntary warranty period, Ji may, subject to applicable law:

  • repair the product;

  • replace the product;

  • provide an appropriate refund; or

  • provide another appropriate remedy.

The appropriate remedy will depend on the nature of the defect, availability of the product and applicable legal requirements.

WHAT THE VOLUNTARY WARRANTY DOES NOT COVER

To the extent legally permissible, the voluntary warranty does not cover damage or failure resulting from:

  • normal wear and tear;

  • cosmetic deterioration that does not affect functionality;

  • misuse;

  • abuse;

  • accidental damage;

  • use for a purpose for which the product was not designed;

  • use contrary to product instructions;

  • failure to follow safety instructions;

  • improper installation or setup;

  • incorrect anchoring or attachment;

  • overstretching beyond recommended limits;

  • modification or alteration;

  • unauthorised repairs;

  • improper storage;

  • exposure to conditions outside the product's stated specifications;

  • use of a product after it should reasonably have been removed from service; or

  • damage caused by another product, accessory or component not supplied or approved by Ji Martial Arts.

These exclusions apply to the voluntary warranty and do not limit statutory consumer rights.

RESISTANCE BAND WEAR AND INSPECTION

Resistance bands and similar elastic products are subject to wear through use.

The rate of wear may depend on factors including:

  • frequency of use;

  • intensity of use;

  • storage conditions;

  • environmental conditions;

  • exposure to heat, sunlight or chemicals;

  • stretching and loading;

  • handling; and

  • compliance with product instructions.

Customers must inspect the product before each use.

A resistance band or related component showing signs of damage, excessive wear, cracking, tearing, deformation or deterioration must not be used.

The voluntary warranty does not guarantee that a resistance product will remain in usable condition for a particular period where deterioration results from normal use or circumstances excluded under the warranty.

PRODUCT SAFETY INVESTIGATIONS AND CORRECTIVE ACTION

If Ji Martial Arts becomes aware of a potential product safety issue, we may take reasonable steps to investigate and address the issue.

This may include:

  • contacting customers;

  • requesting information about the product;

  • requesting photographs or videos;

  • requesting return of a product;

  • suspending sales;

  • issuing safety instructions;

  • replacing affected products;

  • providing refunds;

  • modifying product instructions;

  • removing products from sale; or

  • taking other corrective action where appropriate.

If a product is identified as potentially unsafe, you must follow any safety instructions or recall notices provided by Ji Martial Arts.

Nothing in these Terms limits our legal obligations regarding product safety or corrective action.

PRODUCT RECALLS AND SAFETY NOTICES

Ji Martial Arts may issue product safety notices, withdrawal notices or recall notices where appropriate.

If you receive a recall or safety notice relating to a product you have purchased from us, you must immediately stop using the affected product and follow the instructions provided.

Where applicable, we may request information such as:

  • order number;

  • product identification;

  • batch or serial number;

  • photographs;

  • date of purchase; and

  • information regarding the use or condition of the product.

We may use this information to investigate product safety matters and comply with applicable legal obligations.

CUSTOMER RESPONSIBILITY FOR PRODUCT INFORMATION

You must provide accurate information when placing an order and when communicating with us regarding a product safety issue, warranty claim or return.

You must not knowingly provide false or misleading information regarding:

  • product damage;

  • product use;

  • the circumstances of an incident;

  • ownership;

  • purchase date; or

  • a warranty or return claim.

We reserve the right to investigate suspected fraudulent or abusive claims.

This does not affect legitimate consumer rights or remedies.

All intellectual property rights in the Ji Martial Arts website and its content are owned by or licensed to Ji Martial Arts unless otherwise stated.

This includes, without limitation:

  • logos;

  • trademarks;

  • product names;

  • training materials; and

  • other original content.

You may access and use the website for personal and lawful purposes.

You may not reproduce, modify, distribute, publish, sell, license or commercially exploit our intellectual property without our prior written permission.

USER-GENERATED CONTENT

Where we allow customers to submit reviews, photographs, videos, testimonials or other content ("User Content"), you remain responsible for the content you submit.

By submitting User Content, you confirm that:

  • you have the right to submit it;

  • it does not infringe another person's intellectual property rights;

  • it does not contain unlawful or defamatory material;

  • it does not violate another person's privacy rights; and

  • it complies with applicable law.

Where permitted by law and our applicable policies, you grant Ji Martial Arts a non-exclusive, worldwide, royalty-free licence to use, reproduce, display and distribute User Content for legitimate business, marketing and promotional purposes.

We may remove User Content that we reasonably believe violates these Terms or applicable law.

THIRD-PARTY SERVICES

Our website may use third-party services, including payment processors, shipping providers, analytics providers, marketing platforms and other technology providers.

Third-party services may be subject to their own terms and privacy policies.

We are not responsible for third-party services to the extent that matters are outside our reasonable control.

LINKS TO THIRD-PARTY WEBSITES

Our website may contain links to third-party websites.

These links are provided for convenience and do not constitute an endorsement or guarantee of those websites.

We are not responsible for the content, availability, security or practices of third-party websites.

LIMITATION OF LIABILITY

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

In particular, nothing in these Terms excludes or limits:

  • liability for death or personal injury caused by our negligence;

  • liability for fraud or fraudulent misrepresentation;

  • liability for defective products where liability cannot legally be excluded;

  • your statutory consumer rights;

  • liability that cannot legally be excluded or restricted; or

  • any other liability that applicable law does not permit us to exclude or limit.

Subject to the above, and to the maximum extent permitted by applicable law, Ji Martial Arts will not be liable for losses that are not reasonably foreseeable or for indirect or consequential losses arising from matters outside our reasonable control.

Where you purchase products in the course of a business or commercial activity rather than as a consumer, different legal rules may apply and any applicable limitation of liability will be interpreted to the maximum extent permitted by law.

Nothing in these Terms is intended to deprive a consumer of mandatory legal protections applicable in their jurisdiction.

YOUR RESPONSIBILITY FOR MISUSE

Where legally permissible, Ji Martial Arts will not be responsible for loss or damage arising solely from your failure to:

  • follow product instructions;

  • follow safety warnings;

  • use the product for its intended purpose;

  • inspect the product before use;

  • stop using a visibly damaged or deteriorated product;

  • properly install or attach the product; or

  • comply with applicable product-specific safety requirements.

This section does not exclude or restrict liability that cannot legally be excluded or restricted and does not affect statutory consumer rights.

EVENTS OUTSIDE OUR CONTROL

We will not be responsible for delays or failures caused by circumstances outside our reasonable control.

These may include:

  • natural disasters;

  • severe weather;

  • war;

  • terrorism;

  • civil unrest;

  • government action;

  • strikes;

  • industrial disputes;

  • transport disruption;

  • shipping or customs delays;

  • supplier disruption;

  • manufacturing disruption;

  • cyber incidents;

  • infrastructure failures;

  • epidemics or pandemics; or

  • other events beyond our reasonable control.

Where such an event affects your order, we will take reasonable steps to minimise the impact and communicate with you where appropriate.

Nothing in this section affects statutory rights relating to refunds, cancellation or delivery.

We process personal information in accordance with our Privacy Policy.

By using our website and placing an order, you acknowledge that your personal information will be processed as described in our Privacy Policy.

Where we are required to use personal information to investigate product safety incidents, warranty claims, recalls or other legal obligations, we may process the relevant information for those purposes in accordance with applicable data protection law.

Where our website allows you to create an account, you are responsible for maintaining the confidentiality of your account credentials.

You must notify us if you believe your account has been accessed without authorisation.

We may suspend or terminate accounts where reasonably necessary to protect our business, customers or systems.

Unless expressly stated otherwise:

  • promotions cannot be exchanged for cash;

  • promotional codes may not be combined;

  • promotional codes may be subject to expiry dates;

  • promotions may be limited to specified products or customers; and

  • we reserve the right to correct genuine errors in promotional pricing.

Nothing in this section affects statutory consumer rights.

CHANGES TO THESE TERMS

We may update these Terms from time to time.

The latest version will be published on our website with the relevant "Last Updated" date.

Changes will not retrospectively alter the terms of an order that has already been accepted where doing so would adversely affect your legal rights.

If a material change affects an ongoing relationship with you, we will provide any notice required by law.

SEVERABILITY

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be modified or removed only to the extent necessary.

The remaining provisions will continue to apply.

NO WAIVER

If we do not immediately enforce a right or provision under these Terms, this does not mean that we have permanently waived that right.

A waiver must be expressly given to be effective.

ENTIRE AGREEMENT

These Terms, together with any applicable product-specific terms, policies and information expressly incorporated into them, form the agreement governing your purchase and use of our products, subject to applicable law.

Nothing in this section excludes information or rights that are required by law to form part of the contract.

These rights may include rights relating to:

  • products being as described;

  • satisfactory quality;

  • fitness for purpose;

  • remedies for faulty products; and

  • cancellation of certain distance contracts.

These statutory rights exist independently of our voluntary six-month warranty.

Our six-month warranty is an additional voluntary benefit and does not replace, reduce or remove statutory rights.
